1. Acceptance of these Terms
By downloading, accessing, or using DigiKalo (the “Services”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Services. If you use DigiKalo on behalf of an organization, you represent that you have authority to bind that organization.
2. Description of the Services
DigiKalo provides tools for food photo recognition, estimated calorie and macronutrient tracking, meal logging, weight and goal tracking, daily nutrition scores, streaks, and AI-generated wellness guidance. Features may vary by region, device, subscription tier, app version, or availability of third-party services.
We may improve, modify, suspend, or discontinue features. We will provide notice where required by law, particularly where a change materially affects a paid subscription.
3. Eligibility and accounts
You must be at least 13 years old, or the higher minimum age required in your country, to use DigiKalo. If you are below the age of legal majority, you must have permission from a parent or legal guardian.
You are responsible for accurate account information, maintaining the security of your sign-in credentials, and activity under your account. Notify support@digikalo.com if you suspect unauthorized access.
4. Subscriptions, billing, and cancellation
Some features require a paid subscription. Available plans, prices, currencies, trial terms, and included benefits are displayed before purchase and may differ by platform or country.
- Payment is charged through your Apple App Store or Google Play account when you confirm the purchase.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period, subject to the rules shown by your app store.
- Your app store account may be charged for renewal within 24 hours before the current period ends.
- You can manage or cancel at any time through your Apple or Google subscription settings. Deleting the app or your DigiKalo account does not cancel the store subscription.
- Trials convert to paid subscriptions unless canceled before the trial ends. Any unused trial portion may be forfeited when you purchase a subscription.
- Refunds are handled by Apple or Google under their policies, except where applicable law requires otherwise.
We may change subscription prices with advance notice and any consent required by the applicable app store or law.
5. Health and nutrition disclaimer
Nutrition data is for reference only and does not constitute medical advice. Please consult a qualified physician or registered health professional for special dietary needs, medical conditions, allergies, pregnancy, eating disorders, or treatment decisions.
Food recognition, serving sizes, calories, macros, health scores, goals, and AI coach responses are estimates and may be incomplete or inaccurate. Do not rely on DigiKalo to identify allergens, determine food safety, diagnose a condition, calculate medication, or respond to an emergency. If you believe you have a medical emergency, contact local emergency services.
6. Acceptable use
You agree not to misuse the Services, including by attempting unauthorized access; interfering with security or operation; uploading unlawful, infringing, malicious, or deceptive content; reverse engineering except where law permits; scraping or reselling the Services; abusing free usage limits; or using outputs to make automated high-risk medical decisions.
7. Your content
You retain ownership of photos, records, messages, and other content you submit. You grant DigiKalo a limited, non-exclusive license to host, process, reproduce, and transmit that content only as needed to provide, secure, support, and improve the Services, consistent with our Privacy Policy and your settings or consent.
You represent that you have the rights needed to submit your content and that doing so does not violate law or another person’s rights.
8. DigiKalo intellectual property
The Services, software, branding, designs, documentation, and related content are owned by DigiKalo or its licensors and protected by intellectual property laws. These Terms grant you a limited, personal, revocable, non-transferable, non-exclusive license to use the Services for their intended purpose. No other rights are granted.
9. Third-party services
DigiKalo may depend on app stores, subscription providers, recognition services, nutrition databases, AI providers, cloud platforms, and optional device integrations. Their services may be governed by separate terms and privacy policies. We are not responsible for third-party services beyond what applicable law requires.
10. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee uninterrupted operation or that estimates and AI outputs will be accurate.
To the maximum extent permitted by law, DigiKalo will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill arising from use of the Services. Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory consumer rights.
11. Suspension, termination, and account deletion
You may stop using DigiKalo at any time and may request account deletion through the app or our public Delete Account page. We may suspend or terminate access where reasonably necessary for security, legal compliance, nonpayment, material breach, or protection of users and the Services. Where appropriate, we will provide notice and an opportunity to appeal.
Provisions that by their nature should survive termination—including intellectual property, disclaimers, liability limits, and dispute provisions—will survive.
12. Governing law and disputes
These Terms are governed by the laws of [insert governing jurisdiction], without regard to conflict-of-law principles. Courts located in [insert venue] will have jurisdiction, unless mandatory consumer law gives you the right to bring a claim elsewhere.
Before filing a formal claim, please contact us and give us a reasonable opportunity to resolve the issue informally. This section does not restrict rights that cannot be waived under applicable consumer law.
13. Changes to these Terms
We may revise these Terms as the Services or laws change. We will post the revised Terms, update the effective date, and provide additional notice where required. Continued use after the effective date means you accept the revised Terms, except where explicit consent is required.
